Informed Consent and Waiver of Liability
I, the undersigned, acknowledge and agree to the following terms and
conditions regarding my participation in the fitness program provided by Maine Active LLC:
1. Voluntary Participation
I acknowledge that my participation in the fitness program is voluntary. I understand that
the program may include physical exercises and activities, and that I am participating at
my own risk.
2. Health and Fitness Disclosure
I confirm that I am in good health and able to engage in physical activity. I am not aware
of any medical conditions, injuries, or physical limitations that would prevent me from
participating in the fitness program. If I have any doubts about my ability to participate in
this program, I agree to consult with my physician before beginning.
3. Assumption of Risk
I understand that physical activity, including but not limited to, strength training,
stretching, and cardiovascular exercises, carries inherent risks, including but not limited
to, muscle strains, joint injuries, dizziness, and even serious injury or death. I voluntarily
assume all risks associated with my participation in the program.
4. Waiver of Liability
I hereby release Maine Active LLC, its employees, agents, contractors, instructors, and
affiliates from any liability, claims, demands, or causes of action arising from my
participation in the fitness program, including, but not limited to, injuries, accidents, or
health conditions that may occur before, during, or after participation in the program.
5. Medical Emergency
In the event of an emergency, I authorize the staff of Maine Active LLC to seek medical
treatment for me if necessary. I agree to cover all associated costs for medical treatment,
including any hospital or ambulance fees.
6. Online Participation and Equipment (if applicable)
I acknowledge that the fitness program can take place via virtual means (e.g., online
classes, video conferencing platforms), and that I am responsible for ensuring that I have
the necessary equipment and technology to participate. I agree to maintain a safe
environment free from hazards when participating in the program.
7. Safety of In-Person Classes (if applicable)
I acknowledge that any in-person classes provided by Maine Active LLC will adhere to
safety protocols and guidelines to minimize risks, including social distancing, sanitization
of equipment, and ensuring a safe environment for all participants. I agree to follow all
safety measures and instructions as communicated by Maine Active LLC and its
instructors during in-person sessions. I understand that if I do not follow these safety
protocols, I may be asked to leave the session.
8. No Guarantee of Results
I understand that the results of participation in the fitness program are not guaranteed,
and may vary depending on various factors, including my own effort, adherence to the
program, and physical ability.
9. Confidentiality
Maine Active LLC will maintain confidentiality regarding any personal information
provided by me during the registration process. However, I acknowledge that my
participation in online classes may involve sharing my image and video, which may be
visible to the instructor and other participants during the session.
10. Program Modifications
I understand that Maine Active LLC may, at its discretion, modify, adjust, or cancel the
fitness program. I agree to follow all instructions provided by the instructors and will
inform them of any modifications I need to make to the exercises due to any physical
limitations.
11. Consent to Use of Image and Video
By participating in the fitness program, I grant Maine Active LLC permission to use any
video or image of me for promotional or marketing purposes, including on social media,
websites, and other media platforms. If I do not wish to be recorded, I will notify the
instructor before the session begins.
12. Acknowledgment of Understanding
I have read this waiver and informed consent form thoroughly. I understand the risks
involved in the program and consent to the terms and conditions outlined. I acknowledge
that I have been given the opportunity to ask questions and that all my questions have
been answered to my satisfaction.
